The 2026 Kansas Consumer Funding Law
Kansas passed a consumer legal funding law in 2026. It took effect on July 1, 2026.
| State law | The Transparency in Consumer Legal Funding Act, approved April 9, 2026. |
| What it covers | Advances for household and personal expenses to Kansas residents with a Kansas case. Money for the case’s own costs is outside it. |
| Rate cap | None. Charges must be set amounts tied to time, not a share of your recovery. Prepayment penalties are banned. |
| Right to cancel | Ten business days after funding, by returning the full amount. |
| Disclosure rule | Page one must show the cash amount, one-time charges, the most you could owe and a payment schedule. Your lawyer signs an acknowledgment. |
| Effective date | July 1, 2026, when it was published in the statute book. |
| Registration | Funders must register with the Kansas Secretary of State. |
| As of | October 28, 2026. |
In Kansas, your funding contract is written by a litigation funder registered with the state, as Kansas law requires. Kansas law also says a deal that follows these rules isn’t a loan. If the other side asks in writing, you or your lawyer must tell them you have a funding contract.
Do I qualify?
Yes, provided your attorney has filed or is settling it.
- Your attorney is paid by a contingency fee (your lawyer is paid only if you win), which Kansas law expects.
- Your lawsuit is filed in Kansas, or a settlement agreement is in progress. Bankruptcy trust claims (a claim paid from a fund set up in a bankruptcy) also count.
- It’s a mass tort (many people hurt by the same product or exposure), abuse or rail injury claim, which we take on.
- The defendant, for example a manufacturer, railroad or church, can pay.
People call it a lawsuit loan. It’s a non-recourse advance, not a loan: if you lose, you owe nothing.
Is the case filed outside Kansas? The funded-state list covers that, since the filing state controls. Your credit score never comes up.
How it works
1. Tell us the basics
Send the online application, or call our team on 888-335-3537. Be ready with the case type and your attorney’s name.
2. Attorney review
Your attorney confirms the case, how far along it is and any lien (money that must be paid back from the settlement first). Then your attorney signs the acknowledgment Kansas requires.
3. Study the offer
We can’t quote a price here: it depends on the amount and how long the case runs. Your written offer shows the exact total before you sign.
4. Get funded
Sign the contract, and a wire or check follows. Your lawyer pays us from the settlement before passing the rest to you.
Kansas Lawsuit Loans for Abuse, Rail and Mass Tort Claims
Kansas has no product MDL (similar federal cases grouped before one judge) of its own. Many Kansans still have claims that join national groups, like the talc cases or hernia mesh suits.
We fund both under our mass tort page.
What if my case is moved to another court?
Nothing changes for funding. The court where your suit was first filed is the one that counts, so a later MDL transfer doesn’t matter.
How long do Kansas abuse survivors have?
Kansas gives survivors of child sexual abuse until age 31 to sue. If a related criminal conviction comes later, the deadline moves to three years after it.
These suits often name a church, a school or a youth program too. Funding for them is covered on our sexual abuse page.
Can Kansans with a Scouting claim apply?
Yes. Claims against the Boy Scouts are paid by a trust set up in a Delaware bankruptcy. We fund Delaware, so a survivor living in Kansas can apply. Our Boy Scouts page has the details.
Can rail workers apply?
Yes. Rail employees injured at work bring claims under a federal law, and those cases qualify. See FELA funding.
What shrinks a Kansas offer?
First, the claim has to be filed. After that, big liens or a defendant without assets can lower the figure. Kansas law also keeps the money away from court costs and legal fees.
We also fund civil rights and employment cases. See cases we fund for all of them.
Kansas Lawsuit Loan Questions
What does the 2026 Kansas law change for me?
Your contract must show every charge, the most you could owe and a payment schedule. You get ten business days to cancel. Your lawyer signs a statement in the contract too.
Will the defense find out about my advance?
It can. Under Kansas law, if the other side asks in writing, you or your lawyer must say you have a funding contract. It gives them no say in your case.
Is a Kansas advance a loan?
No. Kansas law says a deal that follows the 2026 rules isn’t a loan. Repayment comes only from the case.
Does my home address matter?
Not for funding: the filing court is what counts. The 2026 law’s protections apply to Kansas residents with a Kansas case.
Can the advance pay for court costs?
No. Kansas law keeps the advance for household and personal needs. Court costs and legal fees are handled by your lawyer.
Kansas Lawsuit Loans That Follow State Law
Since July 2026, Kansas spells out what a funding contract must say, which helps you compare offers. Kansas lawsuit loans let you cover the bills while your attorney keeps the case on track.
You owe nothing on a case that wins nothing, since the funding is non-recourse. Kansas law may change again, and deadlines vary by case. Treat it as a funder’s overview only, not as legal advice.
